Designación de consejerías electorales en Oaxaca

Estoy a favor del proyecto que se presenta para resolver el juicio
ciudadano 858, pues considero que se debe revocar el acuerdo del INE
420 de este año y emitir una nueva convocatoria exclusiva para mujeres
para el proceso de selección de la presidencia del Instituto Electoral de
Oaxaca.


ANTECEDENTES


En este caso, diversas ciudadanas oaxaqueñas se inconformaron con
la convocatoria para la renovación de la presidencia del Instituto
electoral local de Oaxaca.

Consideraron que se debía emitir una
convocatoria exclusiva para mujeres para renovar la presidencia,
debido a que ese cargo nunca ha sido ocupado por una mujer.


PROBLEMA JURÍDICO

A partir de estas impugnaciones, el problema giró en torno a decidir si
el acuerdo impugnado vulneró los principios de paridad y alternancia de
género en los organismos electorales y, en consecuencia, se debe
emitir una nueva convocatoria.


RAZONES PARA VOTAR A FAVOR

Estoy a favor del proyecto, porque coincido en que, dadas las particularidades y el contexto histórico en la integración del OPLE de Oaxaca, debe privilegiarse la selección de una mujer para presidir ese
órgano, lo que, además, es consistente con los precedentes recientes
de la Sala Superior sobre ese tema.


En efecto, estimo que el INE debió emitir una convocatoria para la
presidencia del Instituto local que fuera exclusiva para mujeres por las
siguientes razones:

  • Primero, para cumplir con el objetivo de respetar la alternancia de
    género en un organismo que nunca ha sido presidido por una mujer. En otras palabras, la alternancia de género debe ir más allá de un aspecto cuantitativo. Es importante buscar una verdadera igualdad sustantiva y, para ello, el INE debió tomar en cuenta la particularidad del caso. El objetivo de las medidas de alternancia es remover o disminuir aquellos obstáculos que impidan una paridad real y efectiva, con el pleno goce y ejercicio de los derechos humanos. Así, la emisión de una nueva convocatoria posibilitaría el acceso de las mujeres a cargos directivos o de toma de decisiones al interior de los organisaciones sociales
  • Segundo, porque la solución que se nos propone es consistente con los precedentes de esta Sala Superior en los juicios ciudadanos 117 de 2021 y 739 de 2021, es decir, en los casos relativos a la integración de los OPLE del Estado de México y Chihuahua, en los que precisamente se determinó la necesidad de dar acceso a las mujeres a la posibilidad de presidir esos OPLE, atendiendo a las particularidades de cada caso.


Por estas consideraciones, votaré a favor del proyecto.
