Administrador de empresa de renta de maquinaría pide vehículos en garantía y se los queda

El empresario ha sido denunciado en más de una ocasión por las personas que han sido estafadas pero presume protección de la Fiscalía Miguel Ángel L. C. administrador de la empresa Diazoma Avanzada S. A. de C. V., dedicada a la renta de maquinarias, fue denunciado por fraude y amenazas, luego de recibir un vehículo como garantía para la renta de maquinaría por un mes, y no lo devolviera.La empresa Diazoma Avanzada, S. A. de C. V., expide contratos leoninos con los que comete fraude; ya que pide de garantía algún bien mueble o inmueble durante el tiempo que dure el servicio.


El denunciante J. C. R. S., fue víctima de esta empresa en la que le solicitaron como garantía un automóvil, entregándole el arrendatario de buena fe y cumpliendo con sus requisitos, la factura original y llaves de un vehículo Mercedes Benz Sport, Modelo 2013, además, otro de los requerimientos solicitados por dicho empresario como parte de la misma garantía requerida, era un terreno o casa junto con las escrituras y una carta de donación del bien. Por la necesidad de J. C. R. S., de requerir la emisión de una factura comprobatoria de los servicios, cumplió debidamente con todas las exigencias y fue estafado.


El contrato de la renta de maquinaría fue por 28 días, entregada así la factura original y las respectivas llaves del automóvil de su propiedad junto con las escrituras de su predio, ambos justamente en garantía, y que una vez que concluyó el servicio solicitado bajo las propias exigencias de Miguel Ángel L. C. y habiendo pagado lo pactado por el tiempo de renta de la maquinaria, únicamente se le devolvió la escritura del bien inmueble, no así la factura y las llaves respectivas del coche.


Sin embargo, a pesar de haber puesto las denuncias necesarias y las pruebas respectivas, la Fiscalía General del Estado de Oaxaca no ha hecho nada. Es importante mencionar que se tienen documentos que respaldan y que indican ante la ley que la factura y llaves del citado vehículo fue entregado a un socio de la corrupta empresa, argumentando el mismo empresario de ATRUM MOTORS DE MÉXICO S.A. DE C.V y DIAZOMA AVANZADA. S.A. DE. C.V, que a su empresa nunca le entregaron la factura y llaves, que fue un error haberle proporcionado a una persona física lo ya citado.


Sin embargo el dueño de la unidad, se vio en la necesidad de utilizar el vehículo con el duplicado de la llave, pero al acudir a un restaurante conocido en la ciudad de Oaxaca, en el momento de su salida de dicho establecimiento, se percató que el automóvil se lo habían llevado, teniendo como principal sospechoso a Miguel Ángel L. C., puesto que él hasta la fecha tiene en su posesión las llaves y facturas, y de acuerdo a testigos y cámaras de vigilancias, lo señalan a él como responsable de dicho acto.


Ante este contexto la víctima J.C. y su madre acudieron inmediatamente a denunciar los hechos y reclamar lo que por derecho y justicia les corresponde, sin embargo, esta situación los ha llevado a ambos a ser amenazados, insultados y amedrentados por el señalamiento y la denuncia realizada.
Vale la pena señalar que a pesar de que han pasado cinco años, al mes de febrero del 2022, el caso todavía lo tienen en periodo de investigación, ya que el supuesto empresario oaxaqueño Miguel Ángel L. C., se ha valido de sus amistades y contactos en la fiscalía para que no avance la querella.


Los documentos que se han interpuesto ante las autoridades de los que se mencionan, son respaldados con la carpeta de investigación número 11499/FVCE/OAXACA/2021. Ante la Procuraduría Federal del Consumidor el expediente con PFC.OAX.B.3/000686-2018 y otro más con el expediente PFF.OAXB.3/000/276-2018


Por ello, alerta y hace el llamado de no caer en engaños y fraudes, principalmente a quienes por la ubicación y tipo de servicios arriban directamente a esa compañía; puesto que su dinero, patrimonio y hasta su integridad pueden estar en riesgo por el abuso de poder y por el modo de operar de quien la administra.
